Under what circumstances does a K-3 visa holder’s authorized stay automatically expire?
A K-3 visa holder's authorized stay automatically will expire 30 days after any of the following events:
• USCIS denies the I-130 visa petition filed by the U.S. citizen petitioner on the K-3 visa holder’s behalf; or • USCIS denies an adjustment-of-status application filed by the K visa holder; or • If for some reason the K-3 visa holder decides to apply for an immigrant visa at the appropriate U.S. consulate abroad and the consulate denies the immigrant visa application; or • Divorce of the K-3 spouse from the U.S. citizen petitioner.
